UAE Electronic Invoicing Penalties: Cabinet Decision 173 of 2026
================================================================

2026-10-31 / 13 hours ago

The UAE Cabinet has issued Cabinet Decision No. 173 of 2026 on penalties for breaching the electronic invoicing system, repealing the 2025 decision in full. The Ministry of Finance announced it on 30 October 2026, and it carries an annual ceiling that did not exist before.

What changed in the electronic invoicing penalties
--------------------------------------------------

The decision caps the total at AED 50,000 within any twelve consecutive months for failure to implement the system, removes the penalty for not notifying the Authority of a system failure, and states that a person who is both Issuer and Recipient pays only one penalty for the same violation.

Sheikh Mohammed bin Rashid Al Maktoum, Prime Minister, signed the decision on 24 Rabi' al-Akhir 1448H, corresponding to 6 October 2026. However, Article 5 directs publication in the Official Gazette and sets entry into force from the day after that date. The Gazette therefore starts the clock, not the Ministry's statement and not the signing date.

The legal basis is Federal Decree-Law No. 28 of 2022 on Tax Procedures, since that framework governs how the UAE imposes administrative penalties.

The full table of electronic invoicing penalties
------------------------------------------------

Violation

Administrative penalty

(a) Failure by the Issuer or the Recipient to implement the electronic invoicing system in accordance with Ministerial Decision No. 244 of 2025 and its amendments, or any decision replacing it, including failure to appoint an Accredited Service Provider. (b) Failure by the Recipient, after implementing the system, to maintain compliance with its obligations under Ministerial Decision No. 243 of 2025 and its amendments.

AED 5,000 for the first instance, then AED 5,000 for each month or part thereof during which non-compliance continues, provided the total does not exceed AED 50,000 within any period of twelve consecutive months.

Failure by the Issuer to issue and transmit an electronic invoice to the Recipient through the electronic invoicing system.

AED 100 for each electronic invoice, up to a maximum of AED 5,000 per calendar month.

Failure by the Issuer to issue and transmit an electronic credit note to the Recipient through the electronic invoicing system.

AED 100 for each electronic credit note, up to a maximum of AED 5,000 per calendar month.

Failure by the Issuer or the Recipient to notify the appointed Accredited Service Provider of any change to the data registered with the Authority.

AED 250 for each day of delay or part thereof, up to a maximum of AED 5,000 per calendar month.

Look at the last line. A small data change that never reached your electronic invoicing provider costs AED 250 a day, and it builds up faster than the other three because it runs daily while they run monthly or per invoice.

Three differences from the 2025 decision
----------------------------------------

First, the ceiling. The previous decision set no upper limit on the monthly penalty for failure to implement, whereas the limit is now AED 50,000 within any twelve consecutive months. The ceiling covers paragraphs (a) and (b) together, so a business caught by both does not face a higher limit.

Second, the system-failure penalty is gone. The 2025 decision penalised the Issuer or the Recipient for failing to notify the Authority of a system failure, and the new decision drops it. The Ministry said in its statement that the change allocates responsibility more appropriately among the parties in the electronic invoicing ecosystem, because a failure may sit with the service provider rather than with the taxpayer.

Third, no double penalty. Article 3 provides that where the same person acts as Issuer, Recipient, or both in respect of the same violation, only one administrative penalty applies. That sentence settles a real worry for companies that buy and sell inside the same system, which is most trading companies.

The Ministry says the amendments followed feedback from stakeholders. Anyone who read [the UAE deadline for appointing an accredited service provider](https://hespah.com/en/blog/uae-einvoicing-asp-deadline) knows the pressure came from one item in particular, because a late appointment used to accrue AED 5,000 a month with no visible end.

Who the electronic invoicing penalties cover
--------------------------------------------

The decision applies to violations of the legislation regulating the electronic invoicing system under Federal Decree-Law No. 28 of 2022. However, Article 2 expressly excludes any person who issues, transmits, shares, exchanges or reports electronic invoices and electronic credit notes on a voluntary basis. In other words, an early adopter who joined before the mandatory date is not exposed to these penalties.

The decision defines the Issuer as any person obliged to issue, transmit, share and exchange electronic invoices and credit notes, and likewise defines the Recipient as any person who receives them through the electronic invoicing system. The buyer therefore sits inside the penalty scope exactly as the seller does, and this is where the UAE model parts company with [phase two of e-invoicing in Saudi Arabia](https://hespah.com/en/blog/e-invoicing-phase-2-saudi-arabia), where the integration burden falls on the issuer.

The dates that start your electronic invoicing clock
----------------------------------------------------

Category

Deadline to appoint a provider

Mandatory go-live

Revenue of AED 50 million or more

30 October 2026

1 January 2027

Revenue below AED 50 million

31 March 2027

1 July 2027

Government entities

31 March 2027

1 October 2027

The first category has already passed its date, since the deadline ended on 30 October 2026. Therefore a business that has not appointed an accredited provider by then falls under the first line of the penalty table, because the wording lists failure to appoint a provider as one form of failing to implement the system.

What to do now
--------------

1. Check when you appointed your accredited service provider and that it is registered with the Federal Tax Authority, because that appointment is the first point the Authority measures the electronic invoicing penalty from.
2. Review the data registered with the Authority, including address, tax registration number and contact details, and make sure your provider knows about every change, since this penalty runs by the day.
3. Read your obligations as a Recipient with the same care you give the Issuer side, because your procurement team is now a party to the penalty regime.
4. Run a monthly control over invoices that left your system without reaching the electronic invoicing platform, for example a reconciliation between the sales invoice count and the transmitted count.
5. Put 1 January 2027 in the close calendar and start integration testing well before it, because testing after the mandate starts becomes a violation rather than a trial.

Frequently asked questions
--------------------------

### Do the penalties apply to the buyer as well?

Yes. The first line names the Issuer and the Recipient together for failure to implement electronic invoicing, and likewise the fourth line names them both for failing to notify the service provider of a data change.

### What is the maximum a business can pay?

The AED 50,000 ceiling over twelve consecutive months applies to the first line alone. Each of the other three lines carries its own cap of AED 5,000 per calendar month.

### When does the decision take effect?

From the day following its publication in the Official Gazette, under Article 5. Consequently the 2025 decision stays in force until that moment, then falls away along with any provision that conflicts with the new text.

### Does it cover voluntary electronic invoicing?

No. Article 2 excludes anyone who issues, transmits, shares, exchanges or reports electronic invoices and credit notes voluntarily under the decisions issued pursuant to Federal Decree-Law No. 28 of 2022.
