VAT Penalties in Saudi Arabia and How to Avoid Them
===================================================

2026-10-01 / 3 weeks ago

A small coffee shop failed to keep some of its invoices. The first warning cost it nothing. Repeating the violation after sixty days cost it SAR 5,000. That is how VAT penalties work in Saudi Arabia: a high statutory ceiling, and a field ladder that starts at zero.

What are the VAT penalties in Saudi Arabia?
-------------------------------------------

VAT penalties are financial sanctions that Articles 39 to 47 set out. They start at SAR 10,000 for failing to register, extend to 5% of the unpaid tax for every month of delay, and reach three times the value of the goods in evasion cases. Therefore the ceiling follows the violation type, not the size of the business.

A fine never replaces the tax. Article 46 settles that: it does not affect collection of the tax due, nor does it rule out a heavier sanction under another law. Thus the business pays both.

Table of VAT penalties under the Law
------------------------------------

Two layers of VAT penalties, not one
------------------------------------

That table alone frightens more than it helps, because those figures are ceilings, not fixed amounts. Article 48 explains the gap: ZATCA imposes sanctions under a classification of violations the Board issues by resolution, and it must keep them proportionate.

Accordingly, reading VAT penalties takes two documents together. The Law draws the ceiling, while the Board resolution — the Simplified Guideline on Classifying General VAT Violations, second edition, May 2024 — fixes what an inspector writes up in a field visit. On the other hand registration, filing and payment fines keep their stated percentages, since they never enter the ladder.

The warning comes first: how VAT penalties escalate
---------------------------------------------------

Every general violation opens with a warning and a period to fix the problem. In other words the first occurrence carries no fine. The amounts then climb with each repetition:

The correction window runs from 30 to 60 days depending on the violation. Obstructing ZATCA staff, however, carries a window of ten days only, because of how serious it is.

Then comes the detail that matters most: a violation counts as a repeat only while less than 12 months have passed since ZATCA last detected it. Should it recur after 12 months, it counts as fresh and opens again with a warning. In other words a clean year resets VAT penalties to zero.

Where VAT penalties multiply unnoticed
--------------------------------------

Three multipliers turn a small fine into a painful one:

1. **Charged per field.** For missing mandatory data on an invoice or credit note, ZATCA applies the fine to each field separately. Therefore an invoice short of four fields is not one violation.
2. **Charged per provision and per period.** For record keeping, ZATCA applies the fine to each provision breached, and Article 45 counts it for every tax period. Consequently it multiplies across a full year.
3. **Doubled on repetition.** Article 47 allows doubling the fine where the same violation recurs within three years from the date the previous sanction resolution became final.

Besides the money there is a cost many overlook. Article 48 allows publication of the resolution's operative part at the offender's expense in a local newspaper, once it becomes final.

The exemption from VAT penalties runs to 31 December 2026
---------------------------------------------------------

Hence the most valuable window open right now for anyone carrying accumulated VAT penalties. The Minister of Finance extended the Cancellation of Fines and Exemption of Financial Penalties initiative for six months, from 1 July 2026 to 31 December 2026.

It covers late registration across all tax laws, late payment, late filing, and the VAT return correction fine. Three conditions apply:

1. The taxpayer must hold a valid ZATCA registration for the relevant tax law.
2. The taxpayer must file every return still outstanding.
3. The taxpayer must settle the full principal tax debt tied to those returns, with the option to request instalments, provided the request reaches ZATCA while the initiative runs.

What the initiative excludes
----------------------------

Skim-reading here costs money. It does not cover evasion fines, nor fines under Article 45 — record keeping, obstructing staff, and breaching any other provision — nor fines the taxpayer already paid.

The fourth exclusion matters most: it does not cover fines tied to any return falling due after 30 June 2026. Furthermore ZATCA stated that no later extension will cover those returns either. In short, the initiative closes the door on the past, although it secures nothing ahead.

Seven steps that keep VAT penalties away
----------------------------------------

1. **Register before the law forces you to.** Watch your taxable revenue approach the mandatory threshold, because the SAR 10,000 fine ignores your size. For the detail, [see our guide to VAT registration](https://hespah.com/en/blog/vat-registration-saudi-arabia).
2. **File even when you cannot pay.** These are two independent fines under different articles. Filing on time drops the late filing fine entirely, while late payment stays capped at 5% a month. See [our guide to the VAT return](https://hespah.com/en/blog/vat-return-filing-saudi-arabia).
3. **Review invoice fields one by one.** The fine here follows the field, not the invoice. What drops out most often is the unregistered customer identifier and the QR code. Likewise, [see standard versus simplified invoices](https://hespah.com/en/blog/tax-invoice-vs-simplified-saudi).
4. **Link every device, not some.** The guideline cites a restaurant with three cash registers that linked only two, and fell into the violation. More in [our article on e-invoicing phase two](https://hespah.com/en/blog/e-invoicing-phase-2-saudi-arabia).
5. **Report technical failures.** Staying silent about faults that block invoice issuance is a violation of its own. Nevertheless, proving the fault sits in ZATCA systems lifts the linking violation off you.
6. **Store in the required format and period.** Dumping files into a folder does not count as statutory archiving, since the E-Invoicing Regulation fixes the format and periods.
7. **Treat the warning as a final deadline.** A warning is no formality. It is a counter that started. Fixing the position within 30 or 60 days closes the file without a single riyal.

What to do once the fine lands
------------------------------

Two routes open up. Firstly, Article 42 allows ZATCA to waive or reduce the incorrect return fine under rules its Board sets. That statutory licence deserves a written request backed by documents.

Secondly, Article 49 grants anyone facing a ZATCA resolution the right to object, following the working rules of the Zakat, Tax and Customs Committees. However an objection against VAT penalties runs against deadlines, so do not delay it.

Frequently asked questions about VAT penalties
----------------------------------------------

### Do I face a fine if I file but cannot pay?

Yes, although only the Article 43 fine applies: 5% of the unpaid tax for each month or part of a month. The late filing fine drops away because you filed on time.

### What is the fine for amending a return after filing?

Where the amendment shows tax below the amount due, the fine equals 50% of the difference. However the current initiative covers this fine until 31 December 2026.

### How much is the fine for not registering for VAT?

SAR 10,000 under Article 41, as a flat amount rather than a percentage. In any case the initiative covers it once the taxpayer meets the three conditions.

### Does the fine start from the first occurrence?

Not for general field violations, where a warning and a correction window come first. But VAT penalties on registration, filing and payment run from the first day of delay, since no warning applies.

### Do VAT penalties double on repetition?

Yes. The amount climbs with each repetition inside the 12-month window, and Article 47 further allows doubling it where the violation recurs within three years of the previous resolution becoming final.
